TICKETING TERMS AND CONDITIONS

A. INTRODUCTION

1. Scope

The following terms and conditions (“Terms and Conditions”) are designed to ensure a fair, correct and efficient functioning of the purchase process relating to the tickets for the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP. The sale and use of such tickets are subject to the following Terms and Conditions and any other applicable laws or regulations.

2. Definitions

Applicant: means any individual with legal capacity to apply for Ticket(s) for the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP in accordance with these Terms and Conditions.

Guest(s): means relative(s), close friend(s), colleague(s) and/or the companion to individuals in wheelchairs for whom the Applicant may be applying to purchase and to whom Tickets may be transferred in accordance with these Terms and Conditions.

IFA: means the Israel Football Association, which is responsible for implementing the organisation of the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP in Israel and whose registered office is located at the following address:  299 Aba Hill St  , Ramat Gan, Israel.

Match(es): means any Match(es) that take place as part of the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP.

Stadium: means the entire premises of a stadium in which the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP will be played, including all areas which require a Ticket to gain access, as well as the immediate vicinity of such areas.

Stadium Rules: means the rules governing behaviour and conduct of Ticket Holders at any Stadium at which a Match shall be played, and which all Ticket Holders must comply with. The latest and effective version of the Stadium Rules shall be displayed at  HYPERLINK "http://www.uefa.com" www.uefa.com, www.football.org.il and at each Stadium.

Ticket(s): means a ticket giving right of entrance to the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP in accordance with the information stated thereon. Three categories of Tickets referred to as (A), (B) and (C) categories respectively, may be available for each Match.

Ticket Holder: means any individual holding a Ticket.

UEFA: means the Union des Associations Européennes de Football, with offices at Route de Genève 46, 1260 Nyon, Switzerland.

2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP: means the final tournament of the 2013 UEFA EUROPEAN UNDER-21 CHAMPIONSHIP to be held in Israel between 5 June 2013 and 18 June 2013.

B. SALE OF TICKETS

3. Purchasing

3.1 Tickets will be allocated on a first come, first serve basis. Subject to availability, Tickets may be obtained through the following distribution channels:

On the internet website  HYPERLINK "http://www.uefa.com" www.uefa.com, www.U21Israel2013.com, Leaan.co.il and U21tickets.co.il. as of 28th March 2013 at 10:00 hours CET. Internet applications should be submitted electronically via  HYPERLINK "http://www.uefa.com" http://www.uefa.com, www.U21Israel2013.com, www.Leaan.co.il and www.U21tickets.co.il Only applications that are fully completed by the Applicant will be processed. Applications which are incomplete, unclear, infected by electronic viruses or damaged shall be rejected. Payment shall be made by credit card. The precise details of the procedure will be published on the Internet sites;

Via the Leaan Callcenter +972 3 5247373 as of 28th March 2013 at 10:00. The precise details of the procedure will be published on Leaan website at Leaan.co.il;

For last minute sales on the day of each Match, at the “Ticket Information Points” in each of the Stadiums as of 11th June 2013.

3.2 “Print at home” Tickets shall be available to purchase via the Internet or the Leaan Callcenter up to three hours before the scheduled kick-off time of each respective Match.

3.3 Applicants may be allocated Tickets in a different price category to the one requested provided that the Applicant has duly indicated his/her consent to such possibility during the course of any application.

3.4 The IFA/UEFA is not liable for incorrect entry of information, any technical malfunctions of the Internet, any failure of computer hardware or software, or any lost, incomplete or illegible applications.

3.5 By submitting an application and purchasing Tickets, Applicants represent that they have understood, agreed with and will conform to these Terms and Conditions which can be found on www.uefa.com, on www.U21Israel2013.com, on www.Leaan.co.il and at the Ticket Information Points at the Stadiums.

4. Allocation

4.1 Tickets will be allocated on a first come, first serve basis, and will be always subject to availability.

4.2 In the event that there are any Tickets available for the last-minute sales referred in Article 3.1(d) above, sales will be re-opened individually on a Match by Match basis, on the day of the Match in question via the Ticket Information Point at each Stadium. Tickets will be allocated on a first come first serve basis, subject to availability.

4.3 A limited number of wheelchair seating Tickets (category C) shall be available only for those who are unable to attend a Match without a wheelchair due to a physical disability. An additional complimentary Ticket will be provided for an accompanying person. Tickets will be allocated on a first come, first serve basis.

4.4 All sales are final upon payment. Ticket Holders cannot elect to return or exchange Tickets for which a payment has been made without the prior written approval of the IFA. Administrative or postage charges will not be refunded under any circumstances. Failure to perform payment shall entitle the IFA to cancel the allocated Tickets and reallocate them to another Applicant.

5. Payment and distribution

Payment can be made by credit card as specified in the relevant sales procedures. At the Ticket Information Points at each stadium and at the Leaan retailers, payment in cash will also be possible.

All payments shall be made in the local currency of Israeli New Shekel.

5.3 The total amount due shall include all delivery and/or administrative charges, the cost of which shall be clearly stated during the process of each application.

5.4 Tickets, other than those purchased at a retailer or Stadium pursuant to Articles 3.1(c) or 3.1(d), will be issued online for printing at home for Applicants who have submitted their application electronically, or (where timescales allow) by post to the Applicant, provided that timely and complete payment has been received. Duplicate Tickets will not be issued for any reason whatsoever. In any event, the IFA shall not be held liable for any Ticket loss or late delivery caused by malfunction or interruption of mail and post services.

5.5 Upon request, Applicants shall provide full personal details including their name and address and that of any Guests. In the event that an Applicant refuses to provide such details IFA reserves the right to deny Ticket(s) with no right to refund. Applicants shall be fully and unconditionally responsible for ensuring that Guests are aware of, agree to and comply with these Terms and Conditions and any other applicable rules or regulations. In particular, Applicants are obliged to pass on to their Guests a copy of these Terms and Conditions. In this respect, an Applicant will act as an agent for any Guest and confirms that they are duly authorised to bind the Guest(s).

C. USE OF TICKETS

6. Entrance

6.1 Entrance to the Stadium shall only be authorised upon presentation of a complete and valid Ticket per person (regardless of age) and, upon request, a proof of identity with photograph and valid signature. Ticket Holders leaving the Stadium shall not be re-admitted.

6.2 Any person attending a Match acknowledges that his/her presence in and around the Stadium is at his/her own risk and that, to the maximum extent permitted by law, the IFA/UEFA or any other relevant body cannot be held liable for any risk, danger and loss, including bodily harm, personal property damage or loss, or any other incident whether occurring before, during or after the Match, with the exception of incidents arising from gross negligence and/or wilful misconduct.

6.3 Entrance to the Stadium will be refused to any person noticeably under the influence of alcohol, narcotics or any behaviour-modifying substance, or to any person behaving or who is likely to behave violently, harmfully or contrary to public order. Any such persons who do gain access to a Stadium shall be expelled. In such circumstances no refunds or compensation will be given. Ticket Holders agree to submit to any control and screening tests in accordance with any instructions given by security staff and any applicable laws.

UEFA and/or the IFA shall strictly enforce these Terms and Conditions. All Tickets remain the property of the IFA and, except as set out in Article 8.1, are not transferable. If there is a breach of any of these Terms and Conditions or any other instructions or regulations as communicated by the IFA/UEFA, Tickets shall be void and shall not allow the Ticket Holder entry to the Stadium and the Tickets shall, upon the request of the IFA be delivered up to the IFA. In the event that these Terms and Conditions are conflicting with any IFA regulations or other terms and conditions, these Terms and Conditions will apply.

The Applicant acknowledges and agrees that Tickets are issued subject to any applicable local laws at the Stadium and any regulations or rules in force at the Stadium for the Match. In the event of any discrepancy between (A) the regulations or rules in force at the Stadium and (B) these Terms and Conditions, these Terms and Conditions shall prevail.

The rights represented by any Tickets may only be exercised by the Applicant and any Guests).

7. Safety and security

7.1 For the purpose of maintaining safety and security, all persons attending a Match shall comply with the Stadium Rules, if requested by stewards, safety personnel, and/or any other duly authorised persons, co-operate by at any time:

a) producing a valid Ticket and, upon request, proof of identity with valid photograph and signature;

b) submitting to inspections, body checks and removal of unauthorised objects; and

c) Complying with the instructions and guidelines of such personnel.

7.2 In accordance with the Stadium Rules, the following items may not be brought into the Stadium:

Weapons or explosives of any kind, including anything that could be adapted for use as a weapon or to cut, thrust or stab with, or as a projectile. This includes any fireworks, flares, smoke powder, smoke bombs or other pyrotechnics;

bottles, cups, jugs or cans of any kind as well as other objects made from PET, glass or any other fragile, non-shatterproof or especially tough material;

alcoholic beverages of any kind, drugs, stimulants or psychotropic substances;

racist, xenophobic, religious or political propaganda material;

any promotional or commercial objects or materials;

Flagpoles or banner poles of any kind. Only flexible plastic poles and so-called double-poles that do not exceed 1 metre in length and 1 cm in diameter are permitted;

Gas spray cans, corrosive, flammable substances, dyes or receptacles containing substances which are harmful to health or are highly flammable. Standard pocket lighters are permitted;

professional cameras, video cameras or other similar devices;

Unwieldy objects such as helmets, ladders, stools, (folding) chairs, boxes, large bags, rucksacks, suitcases and sports bags. For the purposes of this rule, “unwieldy” means any objects which are larger than 25cm x 25cm x 25cm and which cannot be stowed under the seat in the Stadium;

large quantities of paper and/or rolls of paper;

mechanically or manually operated sound-emitting devices such as megaphones, klaxons or vuvuzelas;

any food or drinks which have not been purchased within the Stadium;

laser pointers.

The above list is not exhaustive. In case of any doubt with regards to any object being brought to the Stadium, the relevant safety official shall be responsible for defining which objects are prohibited or permitted.

In accordance with the Stadium Rules, it is strictly forbidden to do any of the following inside the

Stadium, without limitation:

throw objects or liquids of any kind, particularly in the direction of another person or in the direction of the area around the pitch or the pitch itself;

start a fire, let off or launch fireworks, flares, or other pyrotechnics;

express or disseminate political, religious, racist, xenophobic propaganda and pursuits or slogans and emblems;

act in a way which may be interpreted by others as provocative, threatening, discriminatory or offensive;

sell goods and tickets, distribute printed material and hold collections or carry out other promotional or commercial activities without prior written authorisation from UEFA (or any official appointed by UEFA);

enter the pitch or the area around the pitch;

climb on or over structures and installations not expressly intended for that use;

write or paint on or affix anything to structural elements, installations or pathways;

relieve oneself anywhere other than in the toilets, or litter the Stadium by discarding objects such as rubbish, packaging, empty containers, etc;

stand on seats in the spectator areas;

any other conduct which is prohibited or is dangerous or threatening.

7.4 Any breach of the Stadium Rules may result in the following penalties being imposed:

a) expulsion from the Stadium and possible handing over to the police;

b) punishment of the offender in accordance with Violence in Sports Law, 2008 and any other Israeli law.

c) banning of the offender from all Stadiums for the duration of the tournament;

d) cancellation and invalidation of the ticket and any other tickets that have already been purchased by such breaching person for other Matches;

e) provision of the relevant personal information to respective national football associations and/or the police so that appropriate measures can  be taken, e.g. national stadium bans;

f) initiating by UEFA or any other authorised persons or entities of legal proceedings;

g) any other penalties or remedies in accordance with applicable laws.

UEFA/IFA reserves all other rights to pursue other legal remedies at its own discretion.

8. Transfer of Tickets

8.1 Applicants shall retain one Ticket for personal use and shall transfer, for no greater than the face value, the remaining Ticket(s) to Guest(s) for their personal use. Subject only to the foregoing sentence, neither Applicants nor Guests may sell, offer for sale, auction by any means (whether alone or with other items), resell or otherwise transfer their personal Ticket without the prior written approval of the IFA.

8.2 Each Applicant shall buy the Tickets exclusively for their own personal use, or for the personal use of his Guest(s). Any other use is prohibited. Subject to the provisions of Article 8.1 above, the Applicant shall not purchase Tickets as an agent for any other person.

9. Commercial Activity

9.1 Tickets may not be used for any commercial purposes such as, without limitation for promotion, advertising, use as a prize in a competition or sweepstake, or as part of a hospitality or travel package (for example combining flights, hotel and Tickets) without the prior written approval of UEFA and the IFA.

9.2 Any person at the Stadium is strictly prohibited from using, possessing or holding goods with promotional or commercial aims, as well as offering to sell, selling or possessing goods with intent to sell such as drinks, food, souvenirs, tickets, clothes, promotional and/or commercial items. Any and all such items may be removed or temporarily confiscated by stewards and/or any other duly authorised persons.

10. Sound and image recordings 

10.1 Any person attending a Match acknowledges that use may be made, free of charge, of his/her voice, image and likeness by means of live or recorded video display, broadcast or other transmission or recording, photographs or any other current and/or future media technologies.

10.2 Any person attending a Match shall not record and/or transmit any sound, image and/or description of the Stadium or the Match (as well as any result and/or statistics of the Match) other than for private use. In particular, it is strictly forbidden to disseminate over the Internet, radio, television or any other current and/or future media, any sound, image, description, result or statistics of the Match in whole or in part, or assist any other person(s) conducting such activities.

D. MISCELLANEOUS

11. Non-compliance with these Terms and Conditions

11.1 Any Ticket Holders whose actions are inconsistent with, or whose Tickets have not been obtained in accordance with, these Terms and Conditions will be refused entry to the Stadium or expelled from the Stadium with no right to refund and the relevant Ticket(s) will be cancelled. Ticket Holders shall be obliged, upon request, to give an explanation as to how, from whom and from where their Tickets have been obtained.

11.2 In the event that it appears that either the Applicant or their Guest(s) have not conformed to these Terms and Conditions, the entire party (Applicant and Guest(s)) will be refused entry to the Stadium or expelled from the Stadium with no right to refund and the relevant Tickets will be cancelled.

11.3 The IFA and UEFA reserve all other legal rights.

12. Indemnification

Applicants and Guests are responsible for the use of all Tickets allocated to them and shall indemnify and hold the IFA and UEFA harmless from and against all damages and liabilities suffered or incurred in connection with, resulting from or arising out the use of the Tickets or of a breach of the Terms and Conditions.

13. Unauthorised spectators

Individuals banned from attending football matches by the competent authorities or sports governing bodies are prohibited from receiving and purchasing Tickets. If this situation occurs, such persons will be refused entry to the Stadium or expelled from the Stadium with no right to refund and the relevant Tickets will be cancelled. Banned individuals whom, despite their banning order, are in or around the Stadium may be penalised. The right to impose further and/or alternative sanctions is reserved by the IFA and UEFA.

14. Data

Applicants acknowledge and agree that the personal data contained in the Application Form is collected by IFA in this particular respect and will be entered into a database owned by IFA and that IFA may transfer such data to third parties. Applicants agree that such personal data will be used primarily in connection with the Ticket sales and/or any relevant safety and security measures. Furthermore, provided that consent has been specifically given by an Applicant during the course of his/her application, personal data can be used in order to provide Applicants with information on products and services of IFA/UEFA.

15. Unforeseen circumstances

14.1 The IFA and UEFA reserves the right to make alterations to the times, dates and places of the Matches due to unforeseen circumstances, including without limitation, force majeure, any safety and security concerns or decisions from UEFA or any other competent authority.

14.2 In the event that any Matches are cancelled, an adequate and proportionate refund/compensation process may be set up depending on the circumstances, within the limits of any applicable law.

17. Severability and amendments

17.1 In the event that any provision(s) of these Terms and Conditions is declared void, ineffective or unenforceable by any competent court, the remainder of these Terms and Conditions shall remain in effect as if such void, ineffective or unenforceable provision(s) had not been contained.

17.2 Within the limits of any applicable law, UEFA reserves the right to make reasonable amendments to these Terms and Conditions from time to time, the most up to date version of which shall be available on the www.uefa.com, on www.U21Israel2013.com, on  HYPERLINK "http://www.leaan.co.il" www.leaan.co.il, at the Ticket Information Points at the Stadiums and, upon request, from the IFA at the address set out in Article 16.

18. Authentic text

These Terms and Conditions have been drafted in English and translated into Hebrew and are available on  HYPERLINK "http://www.uefa.com" www.uefa.com and, upon request, from the IFA in accordance with Article 16. The Applicant acknowledges and agrees that he/she has read and understood these Terms and Conditions and that he/she is fully aware of the rights and obligations arising there from. In the event of any discrepancy between the English and translated texts, the English text shall prevail.

19. Applicable law and jurisdiction

19.1 These Terms and Conditions shall be governed by and interpreted in accordance with the substantive laws of Israel.

19.2 All disputes arising from or related to these Terms and Conditions shall be resolved by the competent court in Tel Aviv, Israel Only. Nevertheless, the IFA/UEFA reserves the right to pursue any legal proceedings in the competent courts at the defendant’s domicile.
